Terms of Use – Kabluchka Jewellery

1. Scope of This Document

1.1. These Terms govern the use of the Kabluchka website (www.kabluchka.com) — browsing the catalogue, creating an account, participating in the Kabluchka Rewards programme, and leaving reviews. The Website is owned by Sole Proprietor (FOP) Ostap Zapiatko (full details — in Section 2 of the Public Offer).

1.2. By using the Website, you agree to these Terms. Purchases are additionally governed by the Public Offer; personal data processing — by the Privacy Policy.

1.3. The Website is available in Ukrainian and English; the Ukrainian version applies to users in Ukraine (Articles 27 and 30 of the Law of Ukraine "On Ensuring the Functioning of Ukrainian as the State Language"). In case of any discrepancy between language versions of the documents, the Ukrainian version prevails.

2. Intellectual Property

2.1. All Website materials — product photographs, texts, descriptions, the Kabluchka name and logo, design elements and layout — belong to the Seller or are used by the Seller lawfully, and are protected by copyright and related-rights legislation.

2.2. You may view and save materials for personal, non-commercial use. Without the Seller's written consent it is prohibited to: copy or republish Website materials on other resources, use product photographs for commercial purposes, or use the name or logo in a misleading manner.

3. Account and Orders

3.1. Orders may be placed with or without an account. You are responsible for the accuracy of the information you provide and for safeguarding access to your account.

3.2. The Seller may suspend an account in the event of a breach of these Terms, fraudulent activity, or systematic unjustified order refusals.

3.3. Participation in the Kabluchka Rewards loyalty programme is governed by the rules set out on the Kabluchka Rewards page.

4. Prohibited Use

It is prohibited to: interfere with the operation of the Website, bypass security measures, use scrapers/bots that create excessive load; post unlawful, offensive content or content infringing third-party rights; impersonate another person; or use the Website for any illegal activity.

5. Reviews and User Content

5.1. By leaving a review or photo, you grant the Seller a non-exclusive, royalty-free right to publish them on the Website and on the store's social media, credited to the name you provide.

5.2. The Seller may decline to publish or may remove content that violates these Terms or the law.

6. Disclaimers

6.1. Information on the Website is provided "as is". The Seller makes reasonable efforts to keep it accurate and up to date but does not guarantee uninterrupted, error-free operation of the Website (including during air-raid alerts, power outages and other force majeure events).

6.2. The colours of metals and stones on screen may differ from reality due to display settings. The characteristics of a specific item are stated in its product description and on its tag.

6.3. Product availability and prices are updated on the Website; final confirmation occurs when the order is processed (see the Public Offer).

6.4. The Website may contain links to third-party resources (carriers, payment services, social media). The Seller is not responsible for their content or policies.

7. Changes to These Terms

7.1. The Seller may update these Terms by publishing a new version on this page with its date. Continued use of the Website after publication constitutes acceptance of the updated version.
