2. Cancellation and Refusal at Receipt
2.1. You may cancel your order, in whole or in part, at any time before dispatch — the amount paid is refunded in full within 3 banking days.
2.2. Upon receipt (at the branch, from the courier, or in store) you have the right to inspect the item. If it does not suit you — refuse it at the moment of receipt: the contract is deemed terminated, and the full amount is refunded within 7 banking days after the shipment arrives back at the Seller (in store — immediately, by the same method used for payment, subject to bank processing times).
2.3. Once you have accepted the shipment without remarks, the rights described in cl. 2.2 are deemed exercised; further returns are possible only on the grounds set out in Sections 3–5.
3. Jewellery of Proper Quality
3.1. Jewellery of proper quality made of precious metals, precious stones, precious stones of organogenic origin and semi-precious stones is not subject to exchange or return. The legal basis is Art. 9 of the Law of Ukraine "On Protection of Consumer Rights" and the List of goods of proper quality not subject to exchange (return) approved by Resolution of the Cabinet of Ministers of Ukraine No. 172 dated 19 March 1994; according to the official clarifications of the Ministry of Justice of Ukraine, this List also applies to goods purchased online.
3.2. That is why, before paying, we recommend: checking your size with our ring size guide or in store, asking our manager about the metal, stones and weight, and using your right of inspection at receipt (cl. 2.2).
3.3. The proper quality of an item is confirmed by the State Assay Hallmark of Ukraine and the manufacturer's product tag (Resolution No. 802).
4. Non-Jewellery Goods of Proper Quality
4.1. Goods that are not precious-metal/stone jewellery (jewellery boxes, silver-plated icons, accessories) may be exchanged or returned within 14 days, not counting the day of purchase/receipt (Articles 9 and 13 of the Law of Ukraine "On Protection of Consumer Rights").
4.2. Conditions: the item has not been used; its merchantable appearance, consumer properties, seals, tags and packaging are preserved; you have the fiscal receipt (e-receipt) or other proof of purchase.
4.3. Items may be returned to our stores (17 Mazepy St. or 2 Sholom-Aleikhema St., Drohobych) or by Nova Poshta shipment after arrangement with our manager. Refunds are issued within 7 banking days from the moment the Seller receives the goods, and in any case no later than the statutory time limits.
5. Personalised Items
5.1. Engraved items and items manufactured to your individual order or individual specifications are not subject to exchange or return (cl. 3, part 5, Art. 13 of the Law of Ukraine "On Protection of Consumer Rights" — goods manufactured to the consumer's individual order). We warn you of this before payment and record the personalisation in the order.
5.2. This restriction does not apply to manufacturing defects in personalised items — in that case the warranty rules apply (Section 6).
6. Defective Goods
6.1. If a defect is discovered within the warranty period (12 months), you are entitled, under Art. 8 of the Law of Ukraine "On Protection of Consumer Rights":
- in case of a material defect — to replacement of the item or termination of the contract with a refund;
- in case of another defect — to free rectification of the defect (within 14 days), a proportionate price reduction, or reimbursement of rectification costs.
6.2. Procedure: write to us at info@kabluchka.com or visit a store, attaching a photo of the item and the receipt. Delivery of the defective item to the Seller and its dispatch after repair/replacement are at the Seller's expense.
6.3. If the cause of the defect needs to be established, we will arrange an expert examination within 3 days of receiving your written claim, at our expense (Art. 17 of the Law). If the examination establishes that the defect arose through the buyer's fault (violation of wear or storage rules, mechanical or chemical damage — see the Warranty Terms), the buyer reimburses the cost of the examination.
6.4. In case of contract termination due to a defect, the refund is issued on the day of termination or, where that is impossible, within 7 days at the latest (part 7, Art. 8 of the Law).
7. How Refunds Are Issued
7.1. Refunds are issued by the same method used for payment: to your card — via the payment service; for instalment plans — via the lending bank (the loan is closed and payments made are refunded by the bank under its own procedure); for cash payments in store — in cash or to your card upon request.
7.2. Crediting time depends on your issuing bank (usually 1–5 banking days after we process the refund).
